Responsible Use and Conduct

By visiting our website and accessing the Resources we provide, whether directly or indirectly, you agree to use these Resources only for the purposes permitted by:

  • The Distance Sales Agreement
  • The Privacy Policy
  • The Cancellation and Refund Policy

The User acknowledges and agrees to the following:

  8. We reserve the right to remove any content that we determine, in our sole discretion, violates this User Agreement or is offensive, harmful, inaccurate, or infringes upon third-party rights. We are not liable for any delay or failure in removing such content. By posting such content, you consent to its removal and waive any claim against us regarding such action.
  9. We assume no responsibility for any content posted by you or other third-party users of our website. However, any content you submit using open communication tools becomes the property of the License Holder, provided that it does not violate any third-party copyright or trademark rights.
  10. We reserve the right to assume exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. You agree to cooperate fully with us in such defense.

Privacy

Your privacy is very important to us. Therefore, we have created a separate Privacy Policy explaining in detail how we collect, manage, process, secure, and store your personal information. The Privacy Policy is an integral part of this Agreement.

Limitation of Warranties

By using our website, you understand and agree that all Resources and Applications are provided “as is” and “as available.”

We do not warrant that:

  1. The use of our Applications or Resources will meet your needs or requirements;
  2. The use will be uninterrupted, timely, secure, or error-free;
  3. The information obtained will be accurate or reliable;
  4. Any defects in functionality will be corrected.

In connection with the Limitation of Warranties stated above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for the use of products and/or services.

The License Holder shall not be liable for any direct, indirect, incidental, consequential, or exemplary loss or damages resulting from the use of the Applications, modifications, data loss, corruption, or cancellation.

Copyrights / Trademarks

All content and materials available on our website, including but not limited to text, graphics, website name, code, images, logos, and downloadable content, are the intellectual property of the License Holder and are protected by applicable copyright and trademark laws.

Any unauthorized use, including reproduction, distribution, display, or transmission of any content on this site, is strictly prohibited unless specifically authorized by the License Holder.

Termination of Use

We reserve the right, at our sole discretion, to suspend or terminate your access to all or part of our website, Applications, or Resources, with or without notice, for any reason, including violation of this User Agreement.

Any suspected illegal, fraudulent, or abusive activity may result in termination and referral to appropriate law enforcement authorities.

Upon suspension or termination, your right to use the Resources will immediately cease, and we reserve the right to delete any account or login information stored in our systems.

Governing Law and Jurisdiction

This website is controlled by Emre İstikam Mimarlık Mühendislik İnş. San. ve Tic. Ltd. Şti., Türkiye.

By accessing our website, you agree that the laws of the Republic of Türkiye, without regard to conflict of law principles and excluding the United Nations Convention on Contracts for the International Sale of Goods, shall govern all matters relating to the use of this website and purchases made through it.

Any legal action relating to this User Agreement shall be brought before the Courts and Enforcement Offices of Istanbul, and you hereby consent to their jurisdiction.

Disclaimer of Warranty

UNLESS OTHERWISE STATED, THE LICENSE HOLDER EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
